hi i actually have a few for you, my fiance was arrested in November for a driving under suspension this makes quite a few on his record. they sent him to jail for a week til i was able to bail him out. first of all they stated he ran a stop sign, the reason for pulling him over, but the cop that supposedly saw this was about a mile up the road on an intersecting road. it was night time but the cop says he was sure it was our vehicle, there would be no way for him to tell that considering it took him how long to catch up to us right? second while he was in jail the arresting officer came to him and tried to pin a possession charge on him stating he found paraphernalia in his car after his shift, now i know this was not his because he does not nor has he ever done drugs. this happened in November while he was in jail asked for an appointed lawyer, which he received, but didn't sign any paper work on it until his pre-trial on June 3, 2009. he finally received his discovery packet on June 3rd, and signed paperwork stating the court would have to appoint him a lawyer, that he has had since November.

my questions are:
1 can he really prove that was my car?
2 is there anything we can do about the wrongful accusations the cop made referencing to the drug charges?
3 how much time can pass before he has to have a trial?
4 how long do they have before he has to receive his discovery packet?
5 isn't there something stating he has to receive a speedy trial? and what constitutes a "speedy trial"?

Well, it is quite difficult to tell because every state has its own rule of traffic & I don't know how is the actually happened.
to consult a lawyer about this matter. I think this would be the best option for you.

Pretty insightful post. Never thought that it was this simple after all. I had spent a good deal of my time looking for someone to explain this subject clearly and you’re the only one that ever did that. Kudos to you! Keep it up
